GENERAL TERMS AND CONDITIONS

1. All persons wishing to participate in the bidding process must be registered in order to bid. By registering, you acknowledge full understanding of the terms and conditions set forth herein. Your bid is a binding contract.

2. Each lot’s closing time is staggered and spaced out in one-minute intervals, which means the second lot is scheduled to close one minute after the first lot. HOWEVER, if anyone places a bid on a particular lot within 5 minutes of its scheduled closure time, 5 minutes will be added to the clock for that particular lot. A five-minute time extension will continue to occur each time a bid is placed within the last 5 minutes until there’s at least 5 minutes remaining with no additional bids.

3. Oahu Auctions is not responsible for any inconsistencies associated with the representation of items (via photos, announcements, printed materials, etc.) and the actual product. Therefore, it is strongly encouraged that you inspect each item you intend to bid on. Bidders should make an informed decision on what item(s) to bid on based on personal inspection of such item(s).

4. All items are sold “as is” and “where is” with no implied warranties or guarantees of any kind.

5. All sales are final. No returns allowed. No refunds or price adjustments will be provided for any reason.

6. Oahu Auctions reserves the right to add/remove items from the auction at any time for whatever reason. Oahu Auctions reserves the right to withdraw/modify any of the items listed in the catalog, flyer, website or any media ads.

7. Oahu Auctions reserves the right to cancel the auction entirely, extend the auction end date, or end the auction early.

8. Oahu Auctions reserves the right to reject or cancel any bid at any time for any reason.

9. A Buyer's Premium of 15% will be added to the winning bid. Total is subject to the Hawaii General Excise Tax of 4.712%.

10. Items must be paid for by December 12 (3:30pm) regardless of the day you're picking up. The credit card that you used to register will be automatically charged after that time if we have not received payment in person by then. Accepted forms of payment: cash, cashier's check, MC/Visa.

11. Buyers are responsible for all costs associated with deinstallation, removal and transport of all purchased items. You must be knowledgeable and qualified to deinstall items connected to electrical and plumbing sources.

12. Pick Dec. 12 & 13 (from 11am to 5pm) at Down to Earth Pearlridge Center. Pickup must be completed by December 13 (5pm). ITEMS NOT PICKED UP BY THE PICK-UP DEADLINE DATE WILL BE CONSIDERED ABANDONED AND SUBJECT TO FORFEITURE WITH NO REFUNDS.

13. Late payments are subject to fees and penalties at the discretion of Oahu Auctions. Unpaid accounts will be turned over to a collection agency, which can affect your overall credit scores up to 7 years. Unpaid accounts are subject to legal action. The bidder information along with the credit card information you provided during the registration process has been verified for identity purposes prior to approval.

14. All items not claimed by the pick-up deadline date/time, is subject to forfeiture, and will be disposed of, resold or donated.

Contents shown in refrigerators, freezers, shelves, deli cases, cabinets, carts, etc. not included unless specified otherwise.
